Prior art voids patents. Secondly, yes, Blockstream's c-lightning is released under FOSS license. But c-lightning isn't even the most popular implementation of LN, LND is (released under FOSS MIT license). Neither Bitcoin not LN could work if they weren't released under FOSS licenses.

This guide explains how backups can be done in c-lightning, and although they do require to be synchronous and thus possibly make your node a little bit less responsive, they allow for complete and autonomous recovery of your on-chain funds, including htlcs that were in-flight during hardware failure. I wasn't fully aware of how advanced they were on this yet, but now I'm convinced to say that hardware failure is a non-issue for c-lightning nodes with synchronous backups. Although there's still work to do to ease the setup. The average Joe will not go through that hassle, it might cost him more than the potential loss..
