Technically, yes, but it is quite difficult to perform a realistic emulation of an OS with shell facilities, as evidenced by all the system emulation on SSH honeypots e.g. cowrie[1].

I'd like to build a database of the login/password associated with failed ssh attempts to my server and am trying to research the legality of this
In EU Law as long as you don't post full names you should be fine. There are honeypots for this purpose ready to deploy btw! Check out Cowrie. Best SSH honeypot I encountered so far.

I don't use password authentication and enforce fail2ban on all of my publicly accessible ssh servers.
Even if someone was to steal my keys or knock at my ssh servers with a zero-day, I will be alerted[0] of the successful login.

Are you capable of securing your online services!
I recently came across a simple script that will send me a telegram alert whenever there's a successful ssh login with the source ip address. Since I don't share server access with anyone else, it'll be easy to catch when someone else other than myself uses my keys.
