As per your second link, "Source Code for Visual Studio Code is available at https://github.com/Microsoft/vscode under the MIT license". The Free Software Foundation itself lists VSCode in its Free Software Directory. It also mentions how to disable telemetry, if you don't want to contribute to the project in that way.
