how many different node implementations exist?

Hello everyone! I've been looking into some cryptos to load up on while everything is crashing and I found HBAR and i have some questions.
The only codebase that has not been open source, is the node codebase with the Hashgraph implementation. The open review of that is currently at https://github.com/hashgraph/swirlds-open-review.

The code has been available for review for a long time, so you can get it (from https://github.com/hashgraph/swirlds-open-review) and get started on your ideas now, so-that you're ready to go commercial once the Apache 2.0 license takes effect.

How do nodes in hashgraph choose who to gossip to?

Mainnet question
Note the current 10,000 TPS is a throttle (transactions above 10,000 TPS are queued by the node software.). You can see the node software at https://github.com/hashgraph/swirlds-open-review if you're curious.

Hedera TPS
The quick answer is that ANYONE can simply build the hashgraph open review codebase from https://github.com/hashgraph/swirlds-open-review and run it in their own private network, and draw conclusions from that.

Is HBAR/Hedera a layer 1 solution?
The proof that it is a Layer 1 is just the fact none of the Hedera services/codebases refer to any other networks (https://github.com/hashgraph/swirlds-open-review, https://github.com/hashgraph/hedera-services, etc.).
