re3/revc is going to court because they included assets in their repository and advertised derivative works/ports, also they haven't been arguing full clean room reverse engineering. zret's oot mq is a clean room matching decomp that doesn't distribute or include the assets (requires you provide your own ROM to pull assets from) and explicitly notes they do not nor do not plan to offer extensions or derivatives, just the clean room matching decompile source code they generated.
Of course anyone can submit a case if they like but it'd be a lot less likely to enter an actual trial like re3/revc. A better comparison would be https://github.com/n64decomp/sm64 which followed the exact same guidelines as this project. Nintendo chased after and DMCA'd many projects based on it but never the original project.
